Examples of Legacy Gift Wording

Easy steps to include a bequest in your will to BC Women’s

Should you wish to remember BC Women’s Hospital & Health Centre Foundation in your Will you might wish to use the wording from the examples below.

  1. specific bequest
  2. rest and residue of estate
  3. contingent bequest
  4. charitable remainder trust

Show these examples to your lawyer and they will ensure that your wishes are accurately followed.

 

1. Specific bequest (a set sum, or “Pecuniary bequest”)

a. To give a sum of money

 “I give to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia the sum of $_______ dollars for purposes determined by its Board of Directors."

OR

“I give to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia the sum of $_______ dollars for the purposes of ________. [You may select a BC Women’s program] In the event that, in the opinion of the Board of Directors of the BC Women’s Hospital & Health Centre Foundation, it should become impossible, inadvisable, or impractical to apply this gift for said purpose, the gift may be used for other purposes consonant with the spirit and intention of this gift."

 

b. To donate particular property

Real estate, stocks, bonds, jewellery, works of art, or other items will be sold unless they are useful to BC Women’s, as determined by its Board of Directors. The proceeds, less any appraisals and selling costs, are applied per the terms of the bequest.

“I give to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia my property known as _______ in the City of ________ for purposes determined by its Board of Directors.”


2. Rest and residue of estate (a proportion or “Residuary bequest”)

When you choose this option BC Women’s is given all or a percentage of what remains of the estate after paying debts, taxes, expenses, and other bequests.

 “I give to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia ___% of the rest, residue, and remainder of my estate for purposes determined by its Board of Directors.”

OR

“I give to BC British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia ___% of the rest, residue, and remainder of my estate for the purposes of ________. [You may select a BC Women’s program] In the event that, in the opinion of the Board of Directors of the BC Women’s Hospital & Health Centre Foundation, it should become impossible, inadvisable, or impractical to apply this gift for said purpose, the gift may be used for other purposes consonant with the spirit and intention of this gift."

 

3. Contingent bequest

This gift takes place only if your testator is not survived by certain individuals.

“If (names of primary beneficiaries) do not survive me, or shall die within ninety (90) days from the date of my death, or as a result of a common disaster, then I give to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia [describe amount of cash, property, or percentage of residual estate]…”

 

4. Charitable remainder trust

A designated portion of your estate property is used to fund a trust, which then pays the net income to the beneficiaries identified in your will. When the trust terminates (at the death of the beneficiaries or at the end of a term of years), the trust principal is distributed to BC Women’s.

“I direct that my executor raise out of the capital of my estate the sum of $________ to be held and invested by my trustee and to pay to (name of spouse or other individuals) all of the net income which accrues therefrom during (his, her, their) natural lifetimes. Upon the death of _________, such trust fund shall be distributed to British Columbia's Women's Hospital and Health Centre Foundation (Charitable registration number: 890267537 RR0001) of 4500 Oak Street, Vancouver, British Columbia. I appoint (name of person or institution) as trustee of this trust.”

It is important to ensure that the following clause is inserted, whichever wording you choose:

“If at my death any charity named as a beneficiary in this Will or any Codicil hereto has changed its name or amalgamated with or transferred its assets to another body then my Executors shall give effect to any gift made to such charity as if it had been made (in the first case) to the body in its changed name or (in the second place) to the body which results from such amalgamation or to which such transfer has been made.”
